Mi Techo Care Terms & Conditions

Contractual conditions for the Care Check, Care subscriptions and all maintenance, cleaning and monitoring services delivered under Mi Techo Care.

These Terms & Conditions apply in addition to our existing Legal Notice, Privacy Policy and Cookie Policy. They do not replace those documents and only add the conditions specific to Mi Techo Care services.

1. Scope of Mi Techo Care

Mi Techo Care is the maintenance, monitoring and aftercare programme of Mi Techo Solar Energías Renovables S.L. (CIF B44974491), offered as a one-off Care Check or as an annual Care subscription (Care Essential, Care Plus or Care Premium).

These Terms apply to every Care Check, Care subscription and individual Care service ordered by the customer. They complement our Legal Notice and Privacy Policy, and are read together with the Service Level Agreement, which sets out the technical scope, frequencies and response times of each Care level. Where a signed installation contract or quotation contains specific terms for a project, those project terms prevail for that project.

2. Initial Care Check

The Care Check is a one-off, on-site health check of the customer's solar, battery, EV charging or climate installation. It includes a visual and electrical inspection, a performance review, photo documentation and a digital report delivered within 48 working hours of the visit.

The Care Check price is quoted before the visit and is based on the number of panels, inverters and batteries and on the accessibility of the installation. Prices shown on the website and in the online calculator are indicative and exclusive of VAT until confirmed in writing by Mi Techo Solar.

The Care Check is an inspection service. It does not include repairs, replacement parts or corrective work, which are quoted separately and only carried out after the customer's written approval.

3. Care subscriptions

Care subscriptions are annual service agreements. The services, frequencies, response times and discounts of each level are defined in the Service Level Agreement, which forms an integral part of these Terms.

A subscription starts on the date of the first successful payment, or on the date of the first scheduled service visit if this is earlier. Subscriptions are personal to the installation and address stated in the order and may only be transferred to a new owner of the same property with our prior written consent.

4. Preventive maintenance

Preventive maintenance visits are planned in advance by mutual agreement, during working hours. They include the checks listed for the relevant Care level in the SLA, such as inspection of mounting systems, cabling, connectors, protections, earthing, inverters and battery systems, plus tightening and cleaning of components where this can be done safely. Preventive maintenance is intended to reduce, but cannot eliminate, the risk of failure.

5. Cleaning services

Panel cleaning is performed with demineralised or clean water and soft equipment, without abrasive or chemical agents unless agreed in writing. Cleaning frequency depends on the Care level. Water and a safe water supply point are provided by the customer. We may decline cleaning where panels, roof surfaces or fixings are damaged, unstable or unsafe, or where weather conditions do not allow safe working.

6. Monitoring services

Remote monitoring depends on the customer maintaining a working internet connection and on the availability of the manufacturer's monitoring platform and API. Monitoring is performed at the frequency stated in the SLA and is not a real-time, 24/7 surveillance service. Mi Techo Solar is not liable for loss of production caused by portal outages, connectivity loss, firmware changes or third-party platform limitations outside our control.

7. Inspection reports, photo documentation and digital reporting

Each Care Check and maintenance visit is documented with photographs and delivered as a digital report. Reports describe the condition observed at the time of the visit and any recommendations. They are not a certification, structural survey or guarantee of future performance.

The customer consents to photographs being taken of the installation and relevant building parts for documentation, warranty and quality purposes. Photographs are stored in accordance with our Privacy Policy. Use of anonymised images for marketing requires the customer's separate consent.

8. Response times and priority service

Response times per Care level are set out in the SLA and refer to our first substantive response during working hours, not to the time required to complete a repair. Priority handling means the customer is placed ahead of non-subscribed customers in the planning queue; it does not guarantee same-day attendance and depends on parts availability, access and weather.

9. Service limitations and excluded services

Unless expressly agreed in writing, Mi Techo Care does not include:

  • repairs, replacement parts, new equipment, upgrades or system extensions;
  • work on installations not supplied or previously inspected and approved by Mi Techo Solar;
  • roof, structural, waterproofing, gutter or building repairs;
  • faults caused by third parties, DIY intervention, pests, storms, lightning, fire, theft or vandalism;
  • grid, utility, contract or supplier issues, and works required by the network operator;
  • internet, router, Wi-Fi and network infrastructure of the customer;
  • works requiring scaffolding, lifting platforms, rope access or permits, unless quoted separately.

10. Customer responsibilities and safe roof access

The customer shall:

  • provide safe, legal and unobstructed access to the roof, inverter, meter cabinet and battery;
  • ensure the roof structure is sound and able to carry a technician safely;
  • be present or provide an authorised contact at the agreed appointment time;
  • provide power, water and, where relevant, monitoring portal access;
  • report defects, alarms and performance drops without undue delay.

Where safe access cannot be provided, our technicians will not carry out the work. In that case the visit may be rescheduled and a call-out fee may be charged. Appointments cancelled or rescheduled by the customer with less than 24 hours' notice, or failed appointments, may be invoiced at our standard call-out rate.

11. Weather limitations

For safety reasons, roof work is not carried out during rain, storm, high winds, ice, wet surfaces or extreme heat, or where local safety rules prohibit it. Visits affected by weather are rescheduled at the earliest reasonable opportunity at no additional cost, and any related delay does not constitute a breach of these Terms or of the SLA.

12. Replacement parts, additional labour and emergency call-outs

Replacement parts and additional labour are quoted separately and carried out only after written approval by the customer. Care subscribers receive the labour discount stated in the SLA. Travel costs are included within our standard service area as defined in the SLA; outside that area, travel is charged at our standard rate.

Emergency call-outs outside working hours are available as described in the SLA and are charged at our out-of-hours rate, unless the emergency results from a defect for which Mi Techo Solar is responsible under warranty.

Where a fault is diagnosed but the customer declines the recommended repair, Mi Techo Solar is not responsible for any consequences of the unrepaired defect, including loss of production.

13. Warranty limitations and manufacturer warranties

Care services are performed with professional care and are covered by a workmanship warranty of twelve (12) months on the work performed. Equipment remains covered by the applicable manufacturer warranties and by the installation warranty agreed in the original installation contract; Mi Techo Care neither extends nor replaces those warranties.

Manufacturer warranty claims are subject to the manufacturer's own conditions, procedures and timelines. Mi Techo Solar will handle the administrative processing of such claims for Care subscribers as described in the SLA, but is not liable for a manufacturer's refusal, insolvency, delay or discontinued product line.

14. Payment terms

All prices are in euros and exclusive of VAT unless stated otherwise. Care Checks are payable before or on completion of the visit; subscriptions are payable annually in advance. Invoices are due within fourteen (14) days. In case of late payment, statutory interest and reasonable collection costs may be charged and services under the subscription may be suspended until payment is received.

15. Automatic renewal and cancellation

The Care contract is concluded for an initial term of one (1) year from the acceptance date. After the initial term, the contract renews automatically for successive periods of twelve (12) months. Once the first year has elapsed, the customer may cancel at any time in writing to info@mitechosolar.com with at least one (1) month's notice; the cancellation takes effect at the end of the current annual period. Prices may be adjusted at renewal; we will notify any adjustment at least thirty (30) days in advance and the customer may then cancel free of charge.

Consumers may withdraw from a distance contract within fourteen (14) days in accordance with Spanish consumer law. Where the customer expressly requests service within that period, the proportionate value of the services already performed remains payable. Cancellation during a running subscription period does not entitle the customer to a refund of services already delivered.

16. Liability and limitation of damages

Mi Techo Solar is insured for professional and civil liability. Our total liability arising from or in connection with Mi Techo Care is limited, per event or series of related events, to the amount actually paid by the customer for the relevant Care service in the twelve (12) months preceding the event, or to the amount paid out by our insurer if higher.

We are not liable for indirect or consequential loss, including loss of production, loss of subsidy or feed-in revenue, loss of profit, loss of data or business interruption, except in cases of intent or gross negligence, death or personal injury, or where liability cannot be limited under mandatory Spanish law.

This clause complements, and does not override, the limitation of liability published in our Legal Notice, which concerns the use of this website.

17. Force majeure

Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, including extreme weather, natural disasters, fire, epidemics, strikes, war, cyber-attacks, grid or telecommunication outages, government measures and supply chain failures. Obligations are suspended for the duration of the event; if it lasts more than sixty (60) days, either party may terminate the affected services in writing without liability.

18. Health & Safety

Our technicians work in accordance with Spanish health and safety legislation and our internal safety protocols, including fall protection and lock-out procedures. Technicians are entitled to stop or refuse work in unsafe conditions without this constituting a breach of contract. The customer shall keep children, animals and unauthorised persons away from the work area.

19. Customer approvals

Additional work, replacement parts and any service outside the agreed scope require the customer's prior approval by email, signed quotation or confirmed digital acceptance. Digital approvals given through our customer portal, quotation links or email confirmation are valid and binding evidence of consent.

20. Data protection (GDPR)

Personal data collected in connection with Mi Techo Care is processed by Mi Techo Solar Energías Renovables S.L. as controller for the performance of the service contract, legal obligations and legitimate business interests, in accordance with Regulation (EU) 2016/679 and Spanish data protection law. The full details of purposes, legal bases, retention and data subject rights are set out in our Privacy Policy, which is not repeated here. Requests can be sent to info@mitechosolar.com. Cookies and website analytics are governed by our Cookie Policy.

21. Governing law, jurisdiction, severability and entire agreement

These Terms are governed by Spanish law. Any dispute shall be submitted to the competent courts of Málaga, Spain, without prejudice to the mandatory jurisdiction available to consumers at their place of residence.

If any provision is found invalid or unenforceable, the remaining provisions stay in force and the invalid provision is replaced by a valid provision that most closely reflects its purpose.

These Terms, together with the Service Level Agreement, the accepted quotation and the documents referenced above, constitute the entire agreement for Mi Techo Care and supersede earlier maintenance or aftersales proposals for the same services. Amendments are valid only in writing.
